Terms of Service.

These terms are a contract between you and AskFlorence Health, Inc. (“AskFlorence Health,” “AskFlorence,” “we,” or “us”). By using askflorence.health or any related service (the “Service”), you agree to these terms. If you do not agree, do not use the Service.

We tried to keep this short and in plain language. The important parts are in bold.

What AskFlorence is

AskFlorence helps people understand their health insurance options and eventually find and enroll in coverage through the Affordable Care Act marketplaces. Today the Service includes a public website, a plan and subsidy quote calculator, a waitlist, an agent discovery platform, and informational content about coverage.

AskFlorence is not a health insurance company, not a licensed broker or agent today, and not a substitute for medical, legal, tax, or financial advice. Quote estimates are based on publicly available data and the inputs you provide. Your actual eligibility and final pricing are determined by the exchange and the carrier you enroll with, not by us.

Who can use the Service

  • You must be at least 18 years old, or the age of majority where you live.
  • You must give accurate information. If you are quoting or enrolling on behalf of a household, you must have authority to act for the people you are including.
  • If you are using the agent portal, you must be a licensed insurance producer in good standing in every state where you accept referrals. You must give us a valid National Producer Number (NPN) and keep your license information current.

What you agree not to do

  • No fraud, no misrepresentation, no falsifying identity, income, or household information.
  • No using the Service to solicit business in a jurisdiction where you are not licensed to do so.
  • No scraping, crawling, or bulk extraction of our content or data without our written permission. Public APIs, when we launch them, will have their own documented limits.
  • No reverse engineering, no probing for vulnerabilities outside a responsible disclosure process, no attempts to bypass authentication or rate limits.
  • No uploading malicious code, spam, or content that infringes someone else’s rights.
  • No using the Service to harass, defame, or harm other users, our staff, or third parties.

We can suspend or terminate access if you break these rules, with or without notice.

Accounts

You are responsible for keeping your account credentials safe. Tell us right away if you think your account has been compromised. You are responsible for activity on your account, except to the extent it was caused by our security failure.

Intellectual property

The Service, including the AskFlorence name, logo, copy, design, code, and original content, is owned by AskFlorence Health, Inc. and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Nothing here transfers any of our intellectual property to you.

If you send us feedback, ideas, or suggestions, we can use them without restriction or compensation. You keep ownership of anything you submit to the Service (like survey responses or support messages), and you grant us the rights we need to run the Service.

Some content on the Service comes from government sources (CMS, state exchanges, state insurance regulators) and from carriers. That content is owned by its respective source and is used in accordance with the applicable license or public access terms.

Third-party services

The Service may link to or integrate with third-party services (government marketplaces, carrier systems, payment processors, analytics, communication tools). Those services have their own terms and privacy practices. We are not responsible for them.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.

Quote estimates, subsidy calculations, plan details, and any other information on the Service may contain errors or be out of date. Always verify your final plan, price, and eligibility with the official marketplace or your carrier before making a coverage decision.

Limitation of liability

To the fullest extent permitted by law, AskFlorence Health, Inc. and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

You do not pay AskFlorence for the Service. The Service is free for consumers. If you enroll in a health plan, any premiums or fees you pay go to the insurance carrier you enrolled with, not to us.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

Indemnification

You agree to defend and indemnify AskFlorence Health, Inc. against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these terms, your misuse of the Service, or your violation of any law or third-party right.

Termination

You can stop using the Service at any time. We can suspend or end your access at any time if you violate these terms, if we are required to by law, or if we need to for security or operational reasons. Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution).

Governing law and dispute resolution

These terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.

Informal resolution first. Before filing any formal claim, email us at hello@askflorence.health and give us 30 days to work it out.

Binding arbitration. If we cannot resolve it informally, you and AskFlorence Health agree to resolve any dispute through binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Delaware or in your home county, at your choice. The arbitrator can award the same damages and relief that a court could.

No class actions. You and we agree to bring claims only in our individual capacities, not as a plaintiff or class member in any class or representative proceeding.

Exceptions. Either party can bring an individual claim in small claims court, or seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

Opt-out. You can opt out of this arbitration agreement by emailing hello@askflorence.health within 30 days of first accepting these terms.

Changes to these terms

We may update these terms from time to time. Every version has a version number and an effective date at the top. Old versions stay accessible at /terms?v=followed by the version number (for example, /terms?v=2026.04), so you can always see the exact text you agreed to. For material changes, we will notify you by email or through the site before the change takes effect. If you keep using the Service after the change takes effect, you accept the new terms.

Miscellaneous

  • Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
  • Severability. If any part of these terms is found unenforceable, the rest stays in effect.
  • No waiver. If we do not enforce a right, that does not mean we give it up.
  • Assignment. You cannot transfer these terms without our written permission. We can assign them to an affiliate or in connection with a sale of the business.
  • Notices. We will send legal notices to the email address on your account. You can send us notices at hello@askflorence.health.
